"you" or "user" or "buyer" or "seller" or "freelancer" refers to you as a user of the Site. "we" or "our" or "us" refers to Deexial Global Ltd. and its subsidiaries individually.
Users guarantee and swear that he or she is at least 18 years old (the legal age of majority, if higher, applies) and that he/she will always provide true, accurate, current, and complete information when submitting information or materials via the Online Platform. Furthermore, the users agree to comply with all applicable local, state, national, and international laws regarding the use of the Online Platform or the use of any product or service that is available. The user also agrees that using the Online Platform is solely at his or her own risk.

- "Fixed Rate Job" is the fixed price placed by sellers for a job or service on Deexial.
- "Milestone hiring" enables buyers to approve payments step-by-step for a service or job on Deexial.
- "Hourly Rate Job" is the charge or price per hour placed by sellers for a job or service on Deexial.
- The "Gig Page" is where the Seller may explain their Gig as well as the terms of the Gig, and the "Gig Page" is also where the Buyer can purchase the Gig and submit an order.
- The services that are available on Deexial are referred to as "Gig/Gigs."
- The "Order Page" is the location where Buyers and Sellers may contact one another regarding a Gig that has been ordered.
- After a purchase has been made through the Seller's Gig Page, an order is an official agreement that takes place between the Buyer and the Seller.
- The "services offered by the seller" are referred to as the "portfolio."
- The "Seller dashboard" is the location where a seller may construct their portfolio and gigs.
- "Status Pending" implies the seller's gig is not yet approved.
- "Status Active" indicates that the seller's gig has been accepted and is now visible on Deexial.
By making use of Deexial
You agree that while using this website, you won't try to or in any other way engage in any of the following activities:

(I). you may not provide anyone's access to your Deexial account, including your feedback, without first obtaining our permission.
(J). publish content that is untrue, incorrect, misleading, deceptive, inflammatory, or libelous (including personally identifiable information).
(K). copy and aggregate listings from our website for display with listings from other websites without receiving our explicit written permission, "frame," "mirror," or otherwise integrate any element of the Website onto any other website without receiving our prior written authorization.
(L). use Deexial to arrange financial transactions, including but not limited to cryptocurrency transactions (e.g. Bitcoin, Ethereum, etc.).
(M). make an effort to alter, translate, adapt, edit, decompile, disassemble, or otherwise reverse-engineer any of the software programs that we use in connection with the Website.
(N). uploading information or materials to our websites and services that are placed in unsuitable categories or places.
(O). duplicate, modify, or distribute any rights or content taken from the Website or the copyrights and trademarks of the Deexial.
(P). do not establish a Deexial profile for someone other than yourself (a genuine person), or use or attempt to use another user's account or information without their permission. Your description, talents, location, and other profile details may remain anonymous, but they must be true and comprehensive and in no way misleading, violate any laws, or be offensive to other people. Deexial has the option of instituting a verification procedure for Site users (whether by using ID, phone, camera, etc.).
(Q). users can only have one active Deexial account at a time to reduce the chances of fraud and abuse. We reserve the right to terminate access to the Deexial platform for anyone who has created multiple accounts to abuse the system in any way. When creating accounts in bulk, you risk having them all disabled. Please be aware that any account(s) found to be violating Deexial's Terms of Service and/or our Community Standards will be permanently suspended.
(R). accounts on the Deexial platform cannot be bought or sold.
(S). you are not permitted to share or disseminate anyone else's personal or sensitive data. The Order Page is the only place where sensitive information like credit card numbers can be freely traded to carry out a service. Sellers further warrant that they will not use any non-public information acquired from the Buyer in any way other than for the express purpose of completing the work for the Buyer. In other words, our Terms of Service do not cover any interactions or communications that take place outside of Deexial.
(T) Deexial will not tolerate any form of unlawful activities and random advertising links on the platform asking users to click. We want to maintain a safe community for everyone. Please don't hesitate to report any unlawful activities by any individual.
Essential Points
On Deexial, buying and selling is open to people who have created an account. When you sign up for an account, you are agreeing to supply us with information that is correct, full, and kept up to date. You also promise that you will not establish an account to defraud or deceive others. You are completely responsible for any activity that occurs on your account as well as for maintaining the secrecy and safety of your password at all times. We cannot be held responsible for any actions or omissions on your part that are related to your account.
There is a possibility that gigs on Deexial will begin at a beginning price of ₦500 or equivalent to any local currency depending on the present exchange rate. Certain Gigs have a basic price that is more than ₦500, and the Seller is the one who decides what that price should be. To place an order, buyers must first make an advance payment to Deexial (Please read our Payment Terms).
Orders may be acquired by clicking the "buy now" button on a seller's Gig page or by taking advantage of a seller's Custom Offer. Please read the Payment Terms for information on costs and payments.
It is not acceptable for sellers to cancel orders without providing a valid reason or fail to fulfill the orders they have accepted. Canceling orders will have an impact on the reputation and standing of the seller.
Account statuses, or Levels, are awarded to sellers based on their performance and reputation in the marketplace. The owners of advanced levels have perks, one of which is the ability to sell multiple copies of their Gig.
Users are not permitted to offer or receive payments in any other way than making an order through the Deexial website.
If the Seller does not specify otherwise on their Gig page, Buyers are granted full rights for the work that is provided to them when they purchase a Gig from that Seller. Please be aware that some gigs require extra charges if they exceed the initial scope set by the seller.
Fundamentals of sales for sellers
- On Deexial, sellers publish their services in the form of "Gigs or services," which are then available for purchase by users. In addition to their Gigs, sellers may provide customers with Custom Offers if they so want.
- After an order has been fulfilled, Deexial grants a Seller an accreditation. Find an explanation of what a finished order entails in the next section under "Orders."
- Please refer to the Payment Terms for further details regarding the fees and taxes associated with accepting payments.
- Through the Google Ads platform, sellers are not permitted to market their Gigs or any other Deexial material.
- The rating of the Seller is determined by taking into account the reviews of individual orders that have been left by Buyers. Receiving high ratings enables sellers to move to higher seller ranks. Extremely low ratings have the potential to get a seller's account terminated in some circumstances.
- Deexial may temporarily block a Seller's capacity to withdraw earnings to avoid fraudulent or illegal conduct. This is done for security reasons. It's possible that this happened because of a security breach, inappropriate activity that was reported by other users, or the fact that numerous Deexial accounts were linked to the same withdrawal provider.
- It is the responsibility of the seller to get a general liability insurance policy with coverage limits that are adequate to cover all of the risks that are involved with the performance of the services they offer.
User-generated content on Deexial consists of gigs that users make.
Gigs and/or users may be removed from the Site at the discretion of Deexial for violating these Terms of Service. These violations and/or materials may include (but are not limited to) the following offenses and/or materials:

Within the area that contains the Gig description and requirements, sellers are not allowed to include URLs or links to external websites. Gigs that link to websites that promote content that is found to violate either Deexial's Terms of Service will be deleted.
It is needed that Gigs have an acceptable picture that corresponds to the service that is being provided. All Sellers have access to the opportunity to submit extra Gig photos on their profile. Sellers are required to provide a service of the same high quality as is depicted in the photos of their Gigs. The Seller's account can lose its Seller status or become permanently deactivated if recurring deliveries do not meet the quality standards outlined in the photos associated with the Gig.
Gigs may include an authorized Gig Video that has been uploaded using the Gig management tools that are accessible on Deexial.
Any statements made on the Gig Page that contradict or try to go around our Terms of Service are not allowed. Gigs that are eligible and fall into certain categories will have the opportunity to build up Gig Packages, which will allow them to present their services in organized formats and provide a range of pricing options for the selected Gig.
Levels

Sellers on Deexial have the opportunity to advance their account Levels by increasing their activity, improving their performance, and enhancing their reputation. These are the conditions for progress, and you can find them here. The progression through the levels is maintained by an automatic system, which updates its status at regular intervals. There are now three levels that a Seller may work their way up to Level 1, 2, 3, and Top Rated.
If a seller is unable to provide consistently high-quality service, suffers a significant decline in ratings, or stops delivering items on the schedule, they run the danger of losing their Seller status and all of the perks that come along with it. A Seller's Level might change for a variety of reasons, including but not limited to late deliveries; warnings sent to the Seller's account; and cancellations. The owners of advanced levels are eligible for extra benefits, such as the ability to set greater rates for their Gigs through the use of Gig Extras or to sell multiple copies of their Gigs.
Best Sellers According to Their Ratings
The Top Rated Sellers are determined by a manual selection procedure carried out by the editors of Deexial. Criteria such as seniority, number of sales, exceptionally high ratings, great customer service, high order completion rate, and community leadership are considered. Top-rated sellers are granted access to a wider variety of services than those at lower levels, including private and unrestricted use of beta features as well as priority customer service.
Deexial performs ongoing checks to determine whether or not an applicant is eligible for the top-rated selection. This helps to maintain the high-quality standards and expectations associated with the top-rated selection. Transfer of Material Goods to Their Destinations
Certain services offered by Deexial are carried out in the traditional sense (arts and crafts, collectible items, etc.). Sellers of these kinds of Gigs may choose to incorporate a shipping or waybill fee consideration within their listings or discussed by both parties.
Any tangible deliverables that are to be shipped to Buyers are required for Gigs that have a shipping cost element included.
The shipping or waybill fees that are added to a Gig are only to cover the expenses incurred by Sellers when they ship tangible objects to Buyers.
Important: Customers who purchase Gigs that call for a physical delivery will be required to submit a mailing address before their orders can be processed.
Once the buyer has provided the shipping address, it is the seller's responsibility to arrange for all aspects of the shipment.
Deexial does not manage or guarantee shipping, tracking, quality, or condition of things or their delivery. Deexial shall not be responsible or accountable for any damages or other difficulties that come from shipment or waybill. Having a tracking number is a fantastic tool for warding off disagreements over the shipment or waybill process. When it comes to the delivery of your work, we request that you input the tracking number into the Order Page if it is accessible.
Buyers fundamentals
It is against the rules for you to provide direct payments to Sellers through the use of payment methods that are not part of the Deexial platform. The services that are being requested on Deexial ought to be permitted on Deexial. Users are strongly encouraged not to use the Post a Request tool for anything other than the purpose of searching for services offered by Deexial. Any payment for services should remain on Deexial.
Purchasing

If you have been requested to utilize a different means of payment, you must immediately report this request to the customer support team at Deexial.
Orders Fundamentals
Your order will be processed and a specific Deexial order ID number will be assigned to it as soon as the payment has been validated.
Sellers are required to send finished files and/or proof of work by clicking the Deliver Work button, which can be found on the seller's dashboard. This is done by the service that was purchased and advertised on the seller's Gig.
It is prohibited for Sellers to utilize the Deliver Work button inappropriately to get around the Order guidelines outlined in these Terms of Service. When an order has not been completed, clicking the "Deliver Work" option can result in the cancellation of that order, a negative impact on the Seller's rating, and a warning to the Seller.
After an order has been designated as Delivered and subsequently accepted by a Buyer, the status of the order is changed to "Completed."
We strongly urge both our buyers and sellers to work toward resolving any disputes or disagreements that may arise between the two of them. Users have the option of reporting the issue or getting in touch with the Customer Support Department of Deexial for assistance if this does not work.
Certain gigs on the site provide local services, and for the seller to provide such services, it may be necessary for the buyer and seller to meet in person. When this occurs, users should be aware that Deexial does not guarantee the behavior, conduct, safety, appropriateness, or ability of either Buyers or Sellers. Both the Buyers and the Sellers agree that any risks that may arise as a result of their meeting and/or their use or performance of local services remain solely with them and that Deexial bears no responsibility or liability in connection with any local services that are provided by the Sellers. In the case that the service is carried out on the premises of the Buyers, the Buyers are strongly recommended to obtain appropriate insurance coverage to cover any potential responsibility they may face in their capacity as the owner of the premises. The Terms of Service that Deexial provides will continue to apply to Orders even if they are fulfilled in a setting other than the marketplace.
How Orders are handled
When a Buyer places an order for a Gig, the Seller is alerted both via email and by alerts shown on the site while the Seller is signed into their account. When setting up their Gigs, sellers are obliged to provide an estimated delivery time for their items. If this is not done, the Buyer will be able to cancel the Order when it is tagged as late, which might be detrimental to the Seller's reputation.
For sellers to certify an order as "Delivered," they are required to deliver finished files and/or proof of work by selecting the button labeled "Deliver Completed Work," which can be found on the seller dashboard.
Buyers are accountable for checking all uploaded files for viruses and other malicious software on their own. Deexial will not be held liable for any damages that may arise as a result of the usage of the site, the use of the material, or the transfer of data.
Buyers can use the "Report" feature, which is located on the Order Page, even after an Order has been marked as Delivered if the materials that were delivered do not match the description that the Seller provided on their Gig page or if they do not match the requirements that were communicated by the Seller at the beginning of the order process.
Reviews/Feedback
The opinion reviews that Buyers submit while placing an Order are a crucial component of Deexial's rating model. Reviews show the Buyer's general impression of the Sellers and their level of service. Buyers are advised to express to the Seller any issues they may have with the service they received from the Seller while their order is still live.
One of a Buyer's fundamental rights is to provide a review. Except in cases where there are gross violations of our Terms of Service, feedback reviews won't be deleted.
All feedback reviews must originate from legal sales conducted solely through the Deexial platform by members of our Community to prevent any abuse of our review system. All associated accounts will be permanently suspended for any transactions that were planned, found to artificially boost Seller ratings or to misuse the Deexial platform with purchases from extra accounts.
Buyers' review comments are made public on a Seller's gig page.
The supplied pictures and videos that are sent to a buyer in a delivery message are called work samples. If a buyer opts to publish a work sample while leaving a public feedback review, the work sample is added to the seller's live portfolio on the gig page.
It is unacceptable to withhold services, data, or information needed to finish the Gig's service to get positive reviews or extra work.
Up to 15 days after an Order is marked as complete, users may post reviews on it. After 15 days, no additional reviews may be added to an Order.
By agreeing to mutual cancellations, Sellers may not request that their Buyers remove their feedback reviews.
Once the buyer has submitted their evaluation, the seller will be notified and given the chance to share their experience dealing with the buyer. Please take note that at this time, sellers are unable to access the buyer review.
All written reviews become public once both the seller and the buyer have finished writing them.
Reacting to a review: After both the Buyer's and the Seller's reviews have been made public, the Seller may respond to the Buyer's review from the Order page, which is accessible from the Seller's Gig page and is located below the Buyer's feedback.
You will be considered to have granted Deexial exclusive, royalty-free, fully paid up, permanent, irrevocable, worldwide ownership rights in the Feedback to the extent that you provide Deexial with any comments, suggestions, or other feedback regarding the Deexial platform or the Site as a whole, as well as other Deexial products or services (collectively, the "Feedback"). All communications, including the transfer of data and files, must take place solely on the Deexial platform.

Members who order from rival services to smear other sellers as dishonest will have any reviews they have left on such services removed, and our Trust and Safety department may take other account status-related steps depending on the findings of their investigation.
Users are required to abstain from spamming or recruiting previous Buyers or Sellers to remove or edit reviews or cancel orders that do not comply with the regulations governing order termination or reviews.

Gig description
This is your first opportunity to introduce yourself to potential customers. Be personable, and approachable, and describe your service easily—to guide customers towards making a purchase.
Guidelines:
- Be clear about the purpose of your Gig, and the specific service you are providing
- Highlight the value of your service
- Proofread your Gig description before publishing and ensure that there are no grammatical errors
- Gig descriptions in English are mandatory but you can use additional languages—as long as all the information is also available in English
- Deexial does not allow an external link in your description.
- If you use a URL in your description, your Gig may be denied. Repetitive violations may also cause an account to be restricted
- If contact or login credentials to external sites are necessary for your Gig service, mention this in your Gig requirements.
Tell your customer your requirements to get started by clearly listing this information in the Gig requirements area. Of course, this only applies to you if the service you are providing cannot be completed without specific information from the buyer
Important: Ensure that your Gig/s is/are in line with our Terms of Service.
Reminder. Deexial does not allow users to share personal contact details in their profile or Gig description. Any necessary exchange of personal information required to continue a service may be exchanged within the Order Page. If you use a URL in your Gig, which is not in the above list, your Gig may be denied. Repetitive violations may also cause an account to be restricted.

Privacy
Never include personal contact information or URLs within your image or in the description. If you are using a sample from your portfolio, it may only include previous clients’ information if they provided explicit permission.
Shipping/Waybill
Some of the services on Deexial are delivered physically, such as arts and crafts, collectible items, and so on.
If your service includes physical shipping, please be sure to select this option in your Gig. If you're not selling a physical product, you may not request a shipping fee from your buyers and should not select this option in your Gig.
The Sellers represent and warrant that all material included in their Gigs is their original work and does not infringe on the copyrights, trademarks, or service marks of any third party. Sellers represent and warrant that they have all necessary licenses to exploit any music or stock footage media that may be included in the Gigs. In addition, Sellers warrant that their use of the licensed music or footage will not infringe upon the license's restrictions.
If Deexial receives a notice of suspected copyright or trademark infringement that is both clear and comprehensive, the company will reply. Our policies and procedures for submitting claims about intellectual property can be examined.
Notice of Infractions
It is your responsibility to notify us through the procedures established to manage issues related to content that may violate our Terms of Service and/or our Ethical Guidelines. The Trust and Safety team investigates every incident. The investigation's findings are kept secret to respect people's right to privacy. For additional details, please see our Privacy Policy.
Misconduct
For any reported incidents of user misconduct or violations of our Terms of Service or Community Standards, our Trust and Safety team may issue a warning to the offending user's account. Both the user's email and the user's profile on the Site will receive a warning. Unlike suspensions, warnings do not limit account access, but serious violations can result in the loss of Seller privileges or even permanent account deactivation.

2. Obligations and Responsibilities:

- a) The Freelancer agrees to promptly notify the Platform in writing of any claim or potential claim that may give rise to indemnification under this Policy.
- b) The Freelancer shall fully cooperate with the Platform in the investigation, defense, and settlement of any claim covered by this Policy.
2.2 Platform's Obligations:

4.2 The maximum liability of the Freelancer under this Policy shall be limited to the total amount paid or payable to the Freelancer by the Platform in the twelve (12) months preceding the event giving rise to the claim.
