Gigs and Payments Policy


The following terms (these “Gigs and Payments Terms”) govern the Gigs and Payments you make or receive through www.deexial.com.com (the “Site”), operated by Deexial Global Ltd. 9 Queen Elizabeth Cres, Off Yakubu Gowon Crescent, Asokoro, Abuja, Federal Capital Territory. (23 New Drum Street, London, England, E1 7AY).


Deexial Global Ltd is referred hereto as “Deexial” “we” "our" or “us”.


Please read these Gigs and Payments Terms carefully before creating gigs, ordering services, making payments, or receiving payments through the site. By creating gigs, ordering services, making payments, or receiving payments through the Site, you accept and agree, on behalf of yourself or on behalf of your employer or any other entity (if applicable), to be bound and abide by these Gigs and Payment Terms.


Important Terms:

  • Deexial freelancing services, jobs, and projects platform allows sellers to offer expert or professional online and offline services.
  • Users who purchase services through Deexial are referred to as "Buyers."
  • All of a seller's services are included under the umbrella term "Seller Services."
  • Additional services that are supplied on top of the Seller's Gig for an additional charge that is determined by the Seller are referred to as "Gig Extras."
  • The "Gig Page" is where the Seller may explain their Gig as well as the terms of the Gig, and the "Gig Page" is also where the Buyer can purchase the Gig and submit an order.
  • The services that are available on Deexial are referred to as "Gig/Gigs."
  •  "Milestone hiring" enables buyers to approve payments step-by-step for a service or job on Deexial.
  • "Fixed Rate Job" is the fixed price placed by sellers for a job or service on Deexial.
  • "Hourly Rate Job" is the charge or price per hour placed by sellers for a job or service on Deexial.
  • "Custom Orders/Offers" enables buyers to send or pay a budgetary amount for a service or job. Then, sellers can accept the offer and proceed with the job.
  • The "Order Page" is the location where Buyers and Sellers may contact one another regarding a Gig that has been ordered.
  • After a purchase has been made through the Seller's Gig Page, an order is an official agreement that takes place between the Buyer and the Seller.
  • The "services offered by the seller" are referred to as the "portfolio."
  • The "Seller dashboard" is the location where a seller may construct their portfolio and gigs.
  • "Status Active" indicates that the seller's gig has been accepted and is now visible on Deexial.
  • Revenue is the money that Sellers earn from completed orders and can be withdrawn.
  • Each Gig you sell and complete accredits your account with revenue equal to 100% of the purchase amount.
  • Deexial accredits Sellers once an order is completed.
  • If an order is canceled (for any reason), the funds paid will be returned to the Buyer’s Deexial Balance.
  • Sellers are responsible for paying any direct or indirect taxes, including any GST, VAT, or income tax, which may apply to them depending on residency, location, or otherwise, under provisions of their jurisdiction.
  • Sellers represent and warrant that they comply, and will comply at all times, with their obligations under income tax provisions in their jurisdiction.


Creating a Gig

When you become a seller on Deexial, we recommend that, initially, you create only one Gig and focus your time and effort on that one service. To make your Gig stand out, follow the guidelines below and see Creating a Gig as well as Making the most from your Gig image for more helpful tips and tricks. Once your initial Gig has generated positive customer feedback and you have had multiple sales, you should consider creating more Gigs. 


Gig Guidelines

Gig Title

Make sure that your Gig title is short, clear, and to the point. Deexial show you the demo title that starts with ”I will...” Write "I will'' and complete the sentence with the service you wish to provide

Remember: You want your buyers to recognize what service you offer—immediately.  


Category/Subcategory

Select the most appropriate category and subcategory for the service you offer

If you’re not sure, search Deexial’s marketplace for similar services to see how other sellers have categorized their services.

Deexial also recommends a category and subcategory based on the title of your Gig

Note: Deexial reserves the right to move your Gig to a more relevant category/subcategory if deemed necessary.


Scope & pricing

The gig page allows you to offer services at any price suitable for you.

The gig page should include the different service elements, such as:

Gig description

Revision

Delivery time

Gig extra, etc.

By adding extras, you can potentially upsell your services.


Gig description

This is your first opportunity to introduce yourself to potential customers. Be personable, and approachable, and describe your service easily—to guide customers towards making a purchase.


Guidelines:

  • Be clear about the purpose of your Gig, and the specific service you are providing
  • Highlight the value of your service
  • Proofread your Gig description before publishing and ensure that there are no grammatical errors
  • Gig descriptions in English are mandatory but you can use additional languages—as long as all the information is also available in English
  • Deexial does not allow an external link in your description.
  • If you use a URL in your description, your Gig may be denied. Repetitive violations may also cause an account to be restricted
  • If contact or login credentials to external sites are necessary for your Gig service, mention this in your Gig requirements.

Tell your customer your requirements to get started by clearly listing this information in the Gig requirements area. Of course, this only applies to you if the service you are providing cannot be completed without specific information from the buyer

Important: Ensure that your Gig/s is/are in line with our Terms of Service. 


Reminder. Deexial does not allow users to share personal contact details in their profile or Gig description. Any necessary exchange of personal information required to continue a service may be exchanged within the Order Page. If you use a URL in your Gig, which is not in the above list, your Gig may be denied. Repetitive violations may also cause an account to be restricted.


Media

Guidelines:

Applicable to all the images, videos, audio, and other content you may use (including your work samples)


Make sure that you have the right to use images for commercial purposes.

Example: Stock image with the owner’s right permissions granted

If you use copyrighted images, you face the possibility of your Gig being removed.

If a user notices a Gig that seems too similar to an already existing service, they can report it to Customer Support for investigation.


Images

Guidelines

Be sure to follow our Gig image guidelines

  • Use images that are clear, high resolution (not pixelated), and that have the right dimension.
  • You can upload images that describe or are related, to your Gig service
  • You can add the Deexial watermark to both your delivery's preview and on completed orders, within your Gig portfolio.
  • Never provide any personal contact information in any of your media content
  • In all Design categories, images must be original
  • In all other categories, ensure that you have permission to upload the image
  • Never include personal contact information or URLs within your image or in the description. If you are using a sample from your portfolio, it may only include previous clients’ information if they provided explicit permission.


Shipping/Waybill

Some of the services on Deexial are delivered physically, such as arts and crafts, collectible items, and so on.


If your service includes physical shipping, please be sure to select this option in your Gig. If you're not selling a physical product, you may not request a shipping fee from your buyers and should not select this option in your Gig.


The Sellers represent and warrant that all material included in their Gigs is their original work and does not infringe on the copyrights, trademarks, or service marks of any third party. Sellers represent and warrant that they have all necessary licenses to exploit any music or stock footage media that may be included in the Gigs. In addition, Sellers warrant that their use of the licensed music or footage will not infringe upon the license's restrictions.


If Deexial receives a notice of suspected copyright or trademark infringement that is both clear and comprehensive, the company will reply. Our policies and procedures for submitting claims about intellectual property can be examined.


Notice of Infractions

It is your responsibility to notify us through the procedures established to manage issues related to content that may violate our Terms of Service and/or our Ethical Guidelines. The Trust and Safety team investigates every incident. The investigation's findings are kept secret to respect people's right to privacy. For additional details, please see our Privacy Policy.


Payment/Order Agreements:

  • Sellers shall clearly define the nature and scope of services offered both online and offline, and provide accurate and detailed descriptions in their profiles.
  • Buyers must review and agree to the services offered by sellers before initiating a request.
  • Any changes to the service scope or requirements must be communicated and agreed upon by both parties.
  • Sellers agree to set transparent and fair rates for their services.
  • Buyers shall honour the agreed-upon payment and make payments according to the terms specified by the seller or the agreed amount between both parties.
  • Any additional expenses incurred during the provision of services shall be discussed and agreed upon by both parties before being incurred.
  • We strongly recommend utilizing our secure payment system for all financial transactions to ensure a safe and reliable exchange


Dispute Resolution:

  • In the event of a dispute, it is encouraged for sellers and buyers to attempt resolution amicably through open communication.
  • If a dispute cannot be resolved directly, we provide a formal dispute resolution process, wherein both parties can submit a complaint with all relevant supporting documents and evidence.
  • Our team will review the dispute and make a fair decision within a reasonable timeframe.
  • Sellers and buyers agree to abide by our decision, which will be considered final and binding.

Rights and Interests:

  • Sellers retain ownership of their completed work and intellectual property rights.
  • Buyers shall obtain full rights to the deliverables upon successful completion of the service and full payment.
  • Sellers must respect the confidentiality and privacy of buyer information.
  • Buyers must not reproduce, distribute, or exploit any work provided by sellers without obtaining the necessary rights and permissions.


Cancellation and Refund Policy for Buyers:

At Deexial, we always strive to provide our users with a top-notch, reliable freelancing services platform. However, we understand that unforeseen circumstances can sometimes arise, leading to cancellations or issues with the services rendered. To ensure clarity and transparency, we have crafted a detailed cancellation policy that outlines the guidelines and procedures for various scenarios.


Please review the following guidelines and procedures for each specific situation:


1. When a seller fails to perform the requested service:

  • If a seller fails to perform the requested service, the buyer should notify Deexial immediately through our dedicated customer support channels.
  • Buyers must provide specific details regarding the nature of the failure to perform the service, including any evidence or documentation available.
  • Upon receiving the buyer's complaint, Deexial will investigate the matter and take appropriate action against the seller.
  • If the seller is found to be at fault or unable to rectify the situation, Deexial will offer the buyer alternative options for rescheduling the service or providing a full refund

2. When a seller fails to meet the agreed-upon time frame:

  • If a seller fails to meet the agreed-upon time frame, the buyer should reach out to Deexial within 24 hours of the scheduled service time.
  • Buyers must provide clear evidence to demonstrate that the seller has failed to meet the time frame, such as communication records, etc.
  • Deexial will initiate an investigation into the matter and communicate with the seller regarding the delay.
  • If the seller is unable to provide a satisfactory explanation or a revised time frame, Deexial will offer the buyer alternative options or provide a full refund.

3. When a seller does not deliver satisfactory quality work:

  • If a buyer is dissatisfied with the quality of work delivered by a seller, the buyer should notify Deexial within 24 hours of receiving the completed work.
  • Buyers are required to provide specific details outlining the aspects of the work that are unsatisfactory and provide evidence to support their claim.
  • Deexial will review the Buyer’s complaint and communicate with the seller to seek clarification or request revisions.
  • If the seller fails to rectify the quality issues or provide satisfactory revisions, Deexial will offer the buyer alternative options or provide a partial or full refund, depending on the extent of the dissatisfaction.

4. When a seller proves to be unreliable:

  • If a seller proves to be unreliable, such as repeatedly canceling or rescheduling appointments, the buyer should report the issue to Deexial immediately.
  • Buyers must provide specific details regarding the seller's unreliability, along with any supporting evidence.
  • Deexial will investigate the matter and take appropriate action against the unreliable seller.
  • If the seller's reliability issues persist or cannot be resolved, Deexial will offer the buyer alternative options or provide a full refund.

Refunds and compensation:

- Depending on the specific circumstances outlined above, Deexial will determine the appropriate refund or compensation measure.

- In cases where a full or partial refund is offered, the refund will be processed within 48 hours, and it will be returned to the buyer's wallet for future purchases on Deexial.


Deexial values buyer's satisfaction and aims to address any concerns promptly and fairly. We encourage buyers to reach out to our customer support team in the event of any issues, as this will assist us in ensuring the smooth delivery of a reliable freelancing services platform.


Note: This cancellation and refund policy is subject to periodic review and may be updated by Deexial to reflect changing circumstances and to better serve our users. Any updates or modifications will be communicated through our website.



Cancellation Policy for Sellers


1) Additional Tasks Outside the Agreed Job:

   If a buyer adds additional tasks that were not initially agreed upon without providing additional payment, sellers should follow these steps:

  • a) Communicate with the buyer: Politely inform the buyer about the additional tasks and emphasize that they were not initially included in the agreed job. Request compensation for the extra work.
  • b) Document the communication: Maintain a record of all communication and clearly outline the additional tasks in writing.
  • c) Seek buyer agreement or payment: Sellers have the right to request compensation for the additional tasks. If the buyer agrees to pay for the extra work or provide additional payment, proceed with completing the tasks. However, if the buyer refuses to compensate or reaches an agreement, sellers can proceed with cancellation if deemed fit.


2) Insufficient Requirements:

   If a buyer fails to provide sufficient requirements about the job, it can hinder the seller's ability to deliver the desired results. In such a situation, freelancers should follow these steps:

  • a) Communicate with the buyer: Request additional clarifications or information from the buyer regarding the job requirements.
  • b) Document the communication: Keep a record of all communication and clearly outline the specific information or requirements requested.
  • c) Buyer's cooperation: Sellers depend on buyers to provide necessary details. If the buyer fails to respond or provide the required information within a reasonable timeframe (specified in your communication), sellers can proceed with cancellation if deemed fit.

3) Lack of buyer Response to Chat Requests for More Details:

   If buyers do not respond to chat for additional details about the job, it can hinder the effective progression of the project. Sellers should follow these steps:

  • a) Communicate with the buyer: Send multiple follow-up messages, reminding the buyer about the need for further details and the importance of effective communication.
  • b) Document the communication: Maintain a record of all the follow-up messages, clearly indicating the dates and times of each message sent.
  • c) Buyer response: If the buyer fails to respond to multiple chat requests within a specific timeframe of about 48 hours, sellers can proceed with cancellation if deemed fit.

Penalties and Consequences:

In situations where buyers have disregarded the cancellation policy or failed to meet their obligations, sellers are entitled to take the following steps:

  • 1) Discontinue work: Sellers may halt all work until the issue is resolved, either through, additional communication, or necessary clarifications.
  • 2) Terminate the contract: If the buyer continuously violates the cancellation policy, resulting in an untenable working relationship, sellers have the right to terminate the contract. In this case, sellers should document all instances of buyer non-compliance with the cancellation policy.

Dispute Resolution:

In the event of a dispute that cannot be resolved between the seller and buyer, both parties can request mediation or arbitration through our platform. Our team will assess the situation and attempt to reach a fair resolution for all parties involved.


Please note that this cancellation policy is designed to protect the interests of both sellers and buyers and ensure a fair and transparent working environment. It is essential that sellers actively communicate, document all relevant information, and follow the steps outlined in each scenario to enforce the cancellation policy effectively.


Communication and Supervision Policy

At Deexial, we are committed to providing a seamless platform that connects buyers with skilled sellers for online and offline services. To ensure successful job completion and buyer satisfaction, we have established the following policies regarding buyer-freelancer communication and supervision.


1. Sellers Communication Responsibilities

1.1 All sellers are required to initiate communication with buyers promptly after being selected for a job. This initial contact is crucial for gathering all necessary details relevant to the specific service request.

1.2 Sellers must show a proactive approach by actively engaging with buyers to collect essential information related to the job requirements, preferences, and any customization requests the buyer may have.

1.3 Clear and effective communication is vital to achieving buyer satisfaction. Sellers should maintain open lines of communication throughout the project duration and respond promptly to buyer queries, concerns, or requests for updates.


2. Buyers Supervision Responsibilities for Offline Services

2.1 Buyers are responsible for actively supervising the seller during the service to ensure a satisfactory outcome.

2.2 Buyer involvement helps streamline the service delivery process, leading to better outcomes. Buyers should be available to answer any questions, provide necessary resources or information, and offer guidance whenever required.

2.3 Buyers should actively participate during the service by providing feedback, clarifications, or approvals promptly to avoid unnecessary delays or misunderstandings.

2.4 Buyers should monitor the progress of the service and promptly address any issues or concerns to ensure timely resolution.


Rationale and Benefits:

Effective Communication:

- Effective communication between sellers and buyers facilitates a clear understanding of job requirements, resulting in accurate service delivery.

- Prompt communication allows sellers to address any concerns, seek clarifications, or confirm details, avoiding potential errors or misinterpretations.

- Better communication enhances collaboration, builds trust, and establishes a strong professional relationship between sellers and buyers.


Active Buyer Involvement:

- Actively supervising the seller during the service ensures timely intervention if deviations or issues arise, minimizing the potential for misunderstandings.

- Buyer involvement ensures that the service aligns with their specific needs and preferences, leading to a more satisfactory outcome.

- On-site supervision helps maintain quality standards, allows for real-time feedback, and enables buyers to provide immediate guidance or suggestions for improvement.


By adhering to our Buyer Communication and Supervision Policy, both buyers and sellers can collaborate more effectively, leading to successful job completion and overall buyer satisfaction. We encourage all buyers to actively participate in the service delivery process, as it enhances the quality of the services rendered and ensures a seamless experience.


Risks and Liabilities:

  • Both parties understand that engaging in online and offline services involves certain risks and that we do not assume any liability for any claims, losses, damages, or disputes arising from such services.
  • Sellers shall maintain appropriate insurance coverage to protect themselves and their buyers from any potential liabilities.
  • Buyers should conduct due diligence when selecting a seller and consider relying on relevant reviews and ratings to assess their suitability for the desired tasks.


Notices and Amendments:

  • Any notices or communications between sellers and buyers shall be made through our platform's designated channels.
  • We reserve the right to amend this Policy at any time, and any updates will be communicated to sellers and buyers through the platform.
  • Continued use of our platform following any Policy update shall signify acceptance of the revised terms.

By using our platform, sellers and buyers acknowledge that they have read, understood, and agreed to the terms and conditions outlined in this Services Policy. We encourage all users to maintain open and honest communication to ensure a positive and successful engagement.



Appointment as Limited Payment Collection Agent:

Seller hereby appoints Deexial as Seller’s limited authorized payment collection agent solely to accept payments (via its Payment Services Provider,) from Buyer, and remit those payments to Seller. Seller agrees that payment from Buyer to Deexial shall be considered the same as a made directly to Seller. Buyer’s payment obligation to Seller will be satisfied upon receipt of payment by Deexial (or its Payment Services Provider, as applicable), and Deexial (via its Payment Services Provider, as applicable) is responsible for remitting the funds to the Seller in the manner described in these Payment Terms. If Deexial (via Payment Services Provider) does not remit any such amounts to Seller, the Seller will have recourse only against Deexial and not the Buyer directly. Seller agrees that Deexial may describe or otherwise reflect the terms contained herein in any terms of service, receipts, disclosures, or notices including, but not limited to, receipts provided to Buyers that Deexial may deem necessary or prudent.


Deexial partners with Payment Services Providers for purposes of collecting payments from Buyers, transferring such payments from Buyers to Sellers and holding funds in connection with Deexial Balances. All payment services in connection with the withdrawal of funds on the Deexial platform are performed by Deexial’s Payment Services Providers.


Order Policy


Welcome to Deexial the freelance service marketplace. This Order Policy sets out the rights, responsibilities, and expectations for both freelancers and clients on our platform. We aim to ensure a fair and transparent process for initiating, completing, and delivering orders while protecting the interests of all parties involved.


Initiating an Order:

1. Clients can create an order by posting a project description, specifying project requirements, deliverables, and any necessary attachments.

2. Freelancers can submit proposals for projects they are interested in, demonstrating their skills, expertise, and suitability for the job.

3. Clients may choose a freelancer based on their proposals, ratings, or reviews, and initiate the project.


Completing an Order:

4. Once an order is initiated, the client and freelancer should agree on specific deadlines, milestones, and deliverables. Both parties must be proactive in defining project requirements to avoid miscommunications.

5. The freelancer should complete the work diligently, meeting the agreed-upon specifications and quality standards.

6. Clients should provide timely and constructive feedback to freelancers throughout the project to ensure alignment with expectations.

7. Freelancers should deliver completed work within the specified deadlines and submit it through the Deexial platform, allowing clients to review it promptly.


Revisions and Modifications:

8. Clients have the right to request reasonable revisions or modifications to the delivered work, in line with the original project requirements.

9. Freelancers should promptly address and implement the requested revisions, ensuring client satisfaction.

10. Clients should communicate their revision requests, ensuring they are specific and actionable.

11. Excessive revision requests beyond the agreed scope of work may warrant additional compensation for freelancers.


Communication:

12. Timely and effective communication is crucial throughout the order process. Both clients and freelancers should respond promptly to messages, clarifications, and queries.

13. Clients and freelancers should maintain a professional and respectful tone in all communication on the platform.

14. All communication related to an order should be conducted through Deexial's messaging system to maintain a record of discussions and agreements.


Payment Terms:

15. Clients are required to deposit the agreed-upon project funds into an escrow account once an order is initiated.

16. Freelancers will only be eligible for payment upon successful completion and submission of the agreed deliverables.

17. Deexial will facilitate secure payment transfers upon client approval and release of funds from the escrow account.


Dispute Resolution:

18. In the case of disputes, both clients and freelancers are encouraged to resolve issues amicably through open communication and negotiation.

19. If the dispute remains unresolved, Deexial may act as a mediator and assist in resolving the conflict.

20. In exceptional circumstances where a mutually agreeable resolution is not possible, clients and freelancers can request arbitration, guided by Deexial's process and policies.


Confidentiality and Ownership:

21. All information shared between clients and freelancers during the order process should be treated as confidential unless explicitly agreed upon otherwise.

22. Freelancers must not use any confidential information obtained during an order for personal gain or against the interests of the client.

23. Upon successful completion of an order and full payment, the client retains full ownership of the delivered work, unless otherwise agreed upon.


By engaging in freelance services on Deexial, both clients and freelancers agree to adhere to these policies. Failure to comply may result in account suspension or termination. We strive to foster a trusted and productive environment for all parties involved.



Review Policy for Freelancers and Clients on Deexial


At Deexial, we strive to maintain a fair and transparent review system that enhances trust and fosters positive interactions between freelancers and clients. This review policy outlines the criteria for leaving reviews, the process for resolving disputes or discrepancies, guidelines for the tone and content of reviews, and the consequences of fraudulent or false reviews. We encourage all freelancers and clients to familiarize themselves with this policy to ensure a seamless experience on our freelance service marketplace.


1. Criteria for Leaving Reviews:

1.1 Completion of Agreed-Upon Tasks: Reviews should reflect the freelancer's or client's ability to complete the tasks as outlined in the project agreement.

1.2 Professionalism: Promptness, responsiveness, and adherence to professional conduct are important factors to consider in leaving a review.

1.3 Timeliness: Reviews may take into account the ability of the freelancer or client to meet agreed-upon deadlines.

1.4 Communication: The effectiveness and clarity of communication between freelancers and clients should be factored into reviews.


2. Resolving Disputes or Discrepancies Regarding Reviews:

2.1 In the event of a dispute or discrepancy regarding a review, both the freelancer and the client must attempt to resolve the issue amicably through direct communication.

2.2 If a resolution cannot be reached, Deexial's support team should be contacted for assistance. Relevant evidence and documentation should be provided to facilitate a fair resolution process.


2.3 Deexial will aim to mediate disputes impartially, reviewing all available evidence and communication between the parties involved.


3. Guidelines for Reviews:

3.1 Constructive Feedback: Reviews should focus on providing constructive feedback to help freelancers and clients improve their skills and services.

3.2 Honesty and Integrity: Reviews should reflect genuine experiences and opinions, avoiding false or misleading information.

3.3 Professional Language: Reviews should be written politely and professionally, avoiding personal attacks or offensive language.

3.4 Specificity: Reviews should include specific details about the experience, highlighting both positive aspects and areas for improvement.


4. Consequences of Fraudulent or False Reviews:

4.1 Deexial has a strict policy against fraudulent or false reviews intended to manipulate a freelancer's or client's reputation.

4.2 Any party found to have submitted fraudulent or false reviews may face account suspension or termination.

4.3 Deexial's support team actively monitors and investigates any reports of fraudulent or false reviews and takes appropriate action as necessary.


We hope this review policy provides clear guidelines for both freelancers and clients on Deexial. A transparent and fair review system enhances trust and facilitates positive interactions. Deexial Subscription Policy


This Subscription Policy ("Policy") outlines the terms and conditions governing the subscriptions available on the Deexial freelance service marketplace ("Platform"). By subscribing to any of the available plans, you agree to be bound by the terms of this Policy.

Deexial offers three subscription options: Basic, Professional, and Enterprise. Each subscription plan comes with unique features and pricing as detailed below:

2. Subscription Duration:

Each subscription plan is valid for one month from the date of purchase. The subscription will automatically renew for subsequent months unless canceled.


3. Renewal and Cancellation Procedures:

a. Automatic Renewal:

- Unless canceled, your subscription will automatically renew for subsequent months.

- The renewal fee will be charged to the payment method on file.

b. Cancellation:

- To cancel your subscription, you must log in to your account and follow the cancellation procedure provided on the Platform.

- Cancellation requests must be submitted at least 48 hours before your subscription renewal date to avoid being charged for the next billing cycle.


4. Early Termination Fees:

If you decide to terminate your subscription before the end of the billing cycle, early termination fees may apply. The amount of the fee will depend on the remaining duration of your subscription term and will be deducted from any refund, if applicable.


5. User Data Privacy:

Deexial is committed to protecting your privacy. Please refer to our Privacy Policy for detailed information on how we collect, use, and safeguard your data.


6. Refund Policy:

a. Refunds for Subscription Fees:

- Subscription fees are non-refundable, except as required by applicable laws.

- In case of service disruptions or platform unavailability caused by Deexial, eligible customers may be entitled to a pro-rata refund.


7. Deexial's Rights and Obligations:

a. Deexial reserves the right to modify, suspend, or discontinue any subscription plan or feature at any time, subject to providing reasonable notice to subscribers.

b. Deexial will make reasonable efforts to provide uninterrupted access to the subscribed features of the Platform. However, technical issues, maintenance, or circumstances beyond our control may result in temporary interruptions or unavailability.


8. User Responsibilities:

a. Subscribers are responsible for maintaining accurate payment information and ensuring that their subscription fees are paid on time.

b. Subscribers must comply with Deexial's Terms of Service and Code of Conduct while using the Platform.


Please read this Subscription Policy carefully before subscribing to any plan on the Deexial Platform. By subscribing, you acknowledge that you have read, understood, and agreed to be bound by this Policy.



Withdrawing Revenues

To withdraw your revenue, you must have an account with at least one of Deexial's Payment Service Providers for the withdrawal methods listed below. All funds eligible for Withdrawal will be held on your behalf in an account with Deexial’s Payment Services Provider. All payment services, including withdrawal services, will be provided by Deexial’s Payment Services Provider.


Your Deexial profile can be associated with only one account from each Deexial withdrawal method. A Payment Service Provider withdrawal account can be associated with only one Deexial profile.


Revenues are only made available for withdrawal from the Revenue page following a safety clearance period of 14 days after the order is marked as complete. Rated Sellers are eligible to withdraw revenue following a safety clearance period of 7 days after the order is marked as complete.


Sellers may withdraw their revenues using one of Deexial’s withdrawal options. To withdraw your available revenue, you must click on the designated withdrawal provider to initiate the withdrawal process.


For security concerns, Deexial may temporarily disable a Seller’s ability to withdraw revenue to prevent fraudulent or illicit activity. This may come as a result of security issues, improper behavior reported by other users, or associating multiple Deexial accounts to a single withdrawal provider.


-Withdrawals can only be made in the amount available to you.

-Withdrawal fees vary depending on the withdrawal method.

-Withdrawals are final and cannot be undone. We will not be able to reverse this process once it has begun.


In certain cases, Sellers may withdraw Revenues in several different currencies. All currency exchange services in connection with such withdrawals are performed by Deexial’s Payment Services Providers. Your Deexial Balance is always derived from its NGN (₦) value and, therefore, the local currency amount of your Deexial Balance may change daily by exchange rate fluctuations and also includes conversion fees. Sellers always have the option to withdraw Revenues in NGN (₦).


Sellers will be able to withdraw their revenues from disabled accounts after a safety period of 90 days following full verification of ownership of the account in question, from the day of the last cleared payment received in their account subject to Deexial's approval.


Purchasing


General

Buyers pay Deexial to create an order from a Seller’s Gig page or Custom Offer, using the Checkout button. Deexial partners with Payment Services Providers for purposes of collecting all payments from Buyers, transferring such payments from Buyers to Sellers, and holding funds in connection with Deexial Balances. All payment services in connection with the collection of funds on the Deexial platform are performed by Deexial’s Payment Services Providers.


Deexial serves as Seller’s limited authorized payment collection agent solely to accept payments (via its Payment Services Provider) from Buyer, and remit those payments to Seller. Buyer’s payment obligation to Seller will be satisfied upon receipt of payment by Deexial (or its Payment Services Provider, as applicable), and Deexial (via its Payment Service Provider) is responsible for remitting the funds to the Seller in the manner described in these Payment Terms. If Deexial (via Payment Services Provider) does not remit any such amounts to Seller, the Seller will have recourse only against Deexial and not the Buyer directly.


In most locations, purchases on Deexial can be made by using one of the following payment methods: Credit Card, Flutterwave, or existing Deexial Balance. Additional payment methods may apply in certain locations.


Service fees are added at the time of purchase where you can review and accept the total amount requested to pay. These fees cover administrative fees. The service fees are of the purchase amount.

Your existing Deexial Balance will be automatically applied to your next purchase.


You may not offer Sellers to pay, or make payment using any method other than through the deexial.com site. In case you have been asked to use an alternative payment method, please report it immediately to Customer Support. You agree to receive invoices and/or payment receipts from Deexial in electronic form as PDF documents, by email, or through the site.


To protect against fraud, unauthorized transactions (such as money laundering), claims, or other liabilities, payment information in connection with withdrawals is collected by either Deexial or Deexial’s Payment Services Providers. Payment Services Providers may also collect such other information as necessary for processing withdrawal payments. Deexial is not exposed to the payment information provided to Payment Services Providers, and this information is subject to the privacy policy applicable to the Payment Service Provider.


By using any payment method and/or providing payment details for making purchases on Deexial, you represent and warrant that: (a) you are legally authorized to provide such information; (b) you are legally authorized or have permission to make payments using the payment method(s); (c) if you are an employee or agent of a company or person that owns the payment method, you are authorized by that company or person to use the payment method to make payments on Deexial; and (d) such actions do not violate any applicable law.


Taxes

Deexial may be required by applicable laws to charge users with indirect taxes (such as Sales Tax, VAT, or GST) or to withhold taxes. Any amount Deexial will be required to collect will be in addition to the purchase amount and any other fees payable by the Buyer, and any amount Deexial will be required to withhold will be deducted from the Seller’s revenue, as required by applicable laws.


Indirect taxes are in addition to the price shown on the site, and in any event, any such taxes will always be displayed to the Buyer before payment.


Users are responsible for paying any direct or indirect taxes, including any GST, VAT, or income tax, which may apply to them depending on residency, location, or otherwise, under provisions of their jurisdiction.


Filing a transaction dispute or reversing a payment through your payment provider or your bank is a violation of these Payment Terms. Doing so may get your account temporarily or permanently disabled. Note: Once you have filed a dispute with your payment provider, the funds will be ineligible for a refund due to our obligations towards the payment provider.


If you encounter an issue related to the service provided in an order, you are encouraged to contact the Deexial support team.


Deexial, through its Payment Services Provider, reserves the right to cancel orders or place funds on hold for any suspected fraudulent transactions made on the site.


All transfer and assignment of intellectual property to the Buyer shall be subject to full payment and the delivery may not be used if payment is canceled for any reason.


If an order is canceled (for any reason), the funds paid will be returned to the Buyer’s Deexial Balance.


Revisions to deliveries can be performed by Sellers based on the Seller’s Gig and customer care. Sellers may determine the amount of revisions they wish to offer, including no revisions.


Requests for revisions can be performed through the Order Page while the order is marked as Delivered.


Requesting to gain more services from Sellers beyond the agreed requirements by using the Request Revisions button is not allowed.


Chargeback Policy 


At Deexial, we aim to provide a trustworthy and reliable marketplace experience for both freelancers and clients. We understand that disputes may arise, and to ensure fair treatment for all parties involved, we have established the following chargeback policy:


1. Conditions for Initiating a Chargeback:

1.1. A chargeback may be initiated if the client can provide sufficient evidence to prove the non-receipt of the service or the unsatisfactory quality of the delivered service.

1.2. Clients must take alternative steps to resolve the issue directly with the freelancer before initiating a chargeback.

1.3. Chargebacks will not be initiated for disputes relating to personal preferences or style differences.


2. Evidence Required for a Chargeback Claim:

2.1. Clients must provide valid evidence to support their chargeback claim, such as:

- Proof of communication between the client and the freelancer.

- Proof of payment (e.g., payment receipts, bank statements).

- Any relevant documents or supporting information.


2.2. Clients should ensure that the evidence provided is sufficient to support their claim.


3. Timeframe for Submitting a Chargeback Claim:

3.1. Clients can initiate a chargeback claim within 30 days from the date of the transaction or the completion of the service, whichever comes later.

3.2. Late chargeback claims may be considered on a case-by-case basis, subject to our discretion, and may require additional justifications.


4. Chargeback Process:

4.1. Clients must contact Deexial's customer support team to initiate the chargeback process.

4.2. Deexial will review the evidence submitted by the client and may reach out to the freelancer for their response and any supporting evidence.

4.3. The freelancer will have a designated time (e.g.,7 days) to provide their counter-arguments, evidence, or explanations.


4.4. Deexial will objectively assess all the information provided and make a fair determination based on the evidence and marketplace policies.

4.5. If the chargeback claim is deemed valid, the client will receive a refund for the disputed amount. If it is deemed invalid, the chargeback claim will be rejected.


5. Dispute Resolution:

5.1. If the freelancer disagrees with a chargeback decision, they can contact Deexial's customer support team and provide additional evidence to support their case.

5.2. Deexial will review the additional evidence and reconsider the chargeback decision if warranted.

5.3. If the dispute remains unresolved or escalates, Deexial may suggest alternative methods of dispute resolution, such as mediation or arbitration.


6. Fair Treatment:

6.1. Both freelancers and clients will be treated fairly throughout the chargeback process.

6.2. Deexial will handle all chargeback claims impartially and objectively, ensuring a fair assessment of the evidence presented.

6.3. Confidentiality of personal and financial information will be maintained throughout the chargeback process.


7. Dispute Prevention:

7.1. Deexial encourages effective communication between freelancers and clients to prevent misunderstandings and disputes.

7.2. Clients are advised to carefully review freelancers' profiles, portfolios, and feedback before engaging in a project.

7.3. Freelancers are encouraged to maintain clear communication and deliver high-quality services to mitigate the risk of chargebacks.

Deexial remains the owner of all intellectual property rights associated with the platform, including trademarks, logos, and content. Copying, modifying, or distributing any of this material without prior written consent is strictly prohibited.


Deexial reserves the right to modify, suspend, or terminate the platform at any time, without prior notice, and any liability to users or freelancers.


By using the Deexial platform, you acknowledge that you have read, understood, and agreed to this Gigs and Payment Policy, the Deexial Disclaimers, the Deexial Terms and Conditions, and the Deexial Privacy Policy. If you do not agree with any part of Deexial's policies, please refrain from using our services.
